How the Divorce Process Works
In our state, the divorce process begins when a spouse files for a Petition for Dissolution of Marriage. The spouse filing this document is known as the “petitioner.” In the event that the other spouse, or “respondent,” fails to answer the petition within 30 days, then the divorce case proceeds without their participation. The petitioner prepares a judgment that requests orders involving child support,
child custody, spousal support, visitation, and similar matters(usually with the help of an attorney), files it with the court, and is then granted an official divorce after six months and one day.
In cases where the respondent does answer the petition, paperwork outlining property and income is exchanged between the two parties, in a process termed “discovery.” If either party requests orders with the court regarding divorce related matters, then they are addressed at this point, and the court makes a decision on these matters according to available evidence and both parties’ positions. Once discovery is complete, a trial is set to finalize the terms of the divorce. If the two spouses agree on all of the terms before the trial, then a judgment is drafted and the divorce is made official after six months and one day. If there is a dispute on one or more terms, then the trial moves forward and the judge makes the final decision as to the specifics of the divorce agreement.
